General Terms and Conditions

Article 1 – Definitions

In these general terms and conditions, the following definitions apply:

Cooling-off period:
The period during which the consumer may exercise the right of withdrawal.

Consumer:
The natural person who is not acting in the exercise of a profession or business and who enters into a distance contract with the entrepreneur.

Day:
Calendar day.

Fixed-term contract:
A distance contract relating to a series of products and/or services, the delivery and/or purchase obligation of which is spread over time.

Durable data carrier:
Any means that enables the consumer or entrepreneur to store information addressed personally to them in a way that allows future consultation and unchanged reproduction of the stored information.

Right of withdrawal:
The possibility for the consumer to withdraw from the distance contract within the cooling-off period.

Entrepreneur:
The natural or legal person who offers products and/or services to consumers at a distance.

Distance contract:
A contract concluded within the framework of an organized system for distance selling of products and/or services, whereby exclusive use is made of one or more means of distance communication up to and including the conclusion of the contract.

Means of distance communication:
Any means that can be used to conclude a contract without the consumer and entrepreneur being simultaneously present in the same place.

These general terms and conditions of the entrepreneur.


Article 2 – Identity of the Entrepreneur

Article 3 – Applicability

These general terms and conditions apply to every offer made by the entrepreneur and to every distance contract and order concluded between the entrepreneur and the consumer.

Before the distance contract is concluded, the text of these general terms and conditions will be made available to the consumer. If this is not reasonably possible, it will be indicated before the conclusion of the distance contract that the general terms and conditions can be inspected at the entrepreneur’s premises and will be sent free of charge upon request.

If the distance contract is concluded electronically, the text of these general terms and conditions may be made available electronically before the contract is concluded, in such a way that it can easily be stored by the consumer on a durable data carrier.

If specific product or service conditions apply in addition to these general terms and conditions, the consumer may always rely on the provision that is most favorable to them.

If one or more provisions of these terms are wholly or partially invalid or voided, the remaining provisions shall remain in force and the invalid provision will be replaced by a provision that most closely reflects the original intent.

Situations not covered by these general terms and conditions must be assessed “in the spirit” of these terms.

Any ambiguities regarding interpretation shall be interpreted “in the spirit” of these general terms and conditions.


Article 4 – The Offer

If an offer has a limited validity period or is subject to conditions, this will be expressly stated.

The offer is non-binding. The entrepreneur reserves the right to modify and adjust the offer.

The offer contains a complete and accurate description of the products and/or services offered. Images are a faithful representation, but obvious errors do not bind the entrepreneur.

All images, specifications, and data are indicative and cannot give rise to compensation or termination of the contract.

Each offer contains clear information regarding the rights and obligations related to acceptance, including:

  • The price, excluding customs clearance fees and import VAT

  • Any shipping costs

  • The manner in which the contract will be concluded

  • Whether the right of withdrawal applies

  • Payment, delivery, and execution methods

  • Offer acceptance period

  • Contract storage and accessibility

  • Correction of provided data

  • Available contract languages

  • Applicable codes of conduct

  • Minimum contract duration where applicable

Optional: available sizes, colors, and materials.


Article 5 – The Contract

The contract is concluded when the consumer accepts the offer and meets the stated conditions.

Electronic acceptance is confirmed immediately by the entrepreneur. Until confirmation is received, the consumer may dissolve the contract.

The entrepreneur ensures secure electronic transactions and payment systems.

The entrepreneur may assess the consumer’s ability to meet payment obligations and may refuse orders if justified.

Upon delivery, the consumer will receive:

  1. The entrepreneur’s address for complaints

  2. Instructions regarding the right of withdrawal

  3. Warranty and after-sales service information

  4. Contract details if not previously provided

Each contract is concluded subject to product availability.


Article 6 – Right of Withdrawal

The consumer may withdraw from the contract within 30 days without giving a reason.

The cooling-off period starts the day after receipt of the product.

The consumer must handle the product with care and return it with all accessories, preferably in original packaging.

The consumer must notify the entrepreneur in writing or by email within 30 days and return the product within 30 days thereafter. Products may be returned directly to the supplier in China.

Failure to comply with these conditions makes the sale final.


Article 7 – Costs in Case of Withdrawal

Return shipping costs are borne entirely by the consumer, including return to the country of origin (China).

Refunds will be made within 30 days after receipt of the returned product or proof of return.


Article 8 – Exclusion of the Right of Withdrawal

The right of withdrawal may be excluded for products that:

  • Are custom-made

  • Are personal in nature

  • Cannot be returned

  • Deteriorate quickly

  • Are subject to market fluctuations

  • Are hygiene products with broken seals

And for services relating to accommodation, transport, leisure activities, betting, and lotteries.


Article 9 – Price

Prices will not be increased during the validity period, except due to VAT changes.

Variable pricing due to financial market fluctuations may apply.

Price increases within 3 months are only allowed if legally required.

Import VAT and customs fees are charged by postal or courier services. No VAT is charged by the entrepreneur.

All prices are subject to printing and typographical errors.


Article 10 – Conformity and Warranty

Products comply with the contract, specifications, and legal standards.

Warranty does not affect statutory consumer rights.

Defects must be reported within 30 days. Products must be returned unused and in original packaging.

Warranty does not apply in cases of misuse, modifications, or external conditions.


Article 11 – Delivery and Execution

Orders are executed with care and delivered to the address provided.

Delivery will take place within 30 days unless otherwise agreed.

If delivery is delayed or impossible, the consumer may terminate the contract and receive a refund.

The risk of loss or damage lies with the entrepreneur until delivery.


Article 12 – Fixed-Term Transactions

Consumers may terminate indefinite contracts at any time with one month’s notice.

Fixed-term contracts end automatically unless explicitly renewed under legal conditions.

After one year, contracts may be terminated with one month’s notice.


Article 13 – Payment

Payments must be made within 7 working days after the cooling-off period begins.

Incorrect payment details must be reported immediately.

In case of non-payment, reasonable costs may be charged.


Article 14 – Complaints Procedure

Complaints must be submitted within 7 days of discovery.

Responses will be provided within 30 days.

If unresolved, disputes may be submitted for dispute resolution.

Valid complaints may result in replacement or repair at the entrepreneur’s discretion.


Article 15 – Disputes

All contracts are governed exclusively by Dutch law, even if the consumer resides abroad.
